Three Main Types Of Disability Benefits
There are three main types of workers’ compensation disability benefits you may receive, depending on the extent of your injuries and your job opportunities. In some cases, injured workers are misclassified and this greatly limits their workers’ compensation benefits. Temporary Partial Disability
Are you still able to work, but not in the same capacity as before your injury? Maybe you need to work fewer hours or perform a lower-paying job. If you can still work but your income has decreased, you may be eligible for temporary partial disability benefits. Your employer would be required to compensate you for two-thirds of the difference between your pre- and post-injury incomes. You may receive this compensation for up to 225 weeks.
Temporary Total Disability
If you can no longer perform your job, and your employer cannot offer you an alternate assignment to fit your work restrictions, you may be eligible for temporary total disability benefits. These benefits should compensate you for two-thirds of your lost wages, capped at $850 per week. You can receive temporary total disability benefits for up to 130 days or 90 days after you reach maximum medical improvement.
Permanent Total Disability
If you have suffered a serious work-related injury or illness, leaving you permanently unable to work, you may be eligible for permanent total disability (PTD) benefits until the age of 67. Because paying permanent wage loss benefits is a significant expense for insurance companies, your employer’s insurer is unlikely to agree to your PTD classification. Instead, the insurer would request a hearing. At your hearing, a workers’ compensation judge will listen to testimony from you, medical witnesses and vocational witnesses, as well as consider medical documentation and other evidence.
